How Do I Prove My Personal Injury Claim?

A successful case is one where you prove i) liability, and ii) damages.

Liability means responsibility for your injury. To be compensated for your injury you must first establish that it happened due to the wrongdoing or negligence of another person or entity. Sometimes this is straightforward, such as a rear-end car accident where the driver was drunk or on their phone. Other times it is more complex, such as the case of a poorly engineered product that causes you harm.

The compensation that you receive for your injuries is called damages. The amount of damages you are entitled to depends on the nature and severity of the injuries that you sustained and the degree to which they interfere with your daily activities, such as your ability to earn income or walk without assistance.

How Can I Help My Case?

There are important steps you can take to help your case. These include:

Mitigate your damages.

Do all that you can to get better and recover from your injuries. A court will reduce your damages if you do not take these steps.

Report your ongoing symptoms to your medical team.

It is critical that an ongoing impairment is documented. Reporting improvements and setbacks in your recovery accomplishes two things: i) it gives your medical provider the necessary information to appropriately render care; and ii) it provides documentary evidence of your health status. You cannot prove your damages without documentation.

Tell the truth.

The worst thing you can do to your case is make your credibility an issue. Do not mislead or exaggerate. State the facts.
